Proposed NJ law will help NJ auto accident victims recover, if they are injured while driving for their job
Jun 25th, 2007 | By Michael L. Saile, Jr., Esq. | Category: Blogs, New Jersey Injury InformationNew Jersey currently has an unfair law on its books. This law deals with NJ business or corporate auto insurance policies and provisions called “step-down” clauses. Step-down clauses are part of many business or corporate auto insurance policies in NJ.
Basically, if you are driving a work vehicle or you are insured through your employer’s NJ automobile insurance policy, and you have your own personal NJ auto insurance policy, when you are in an auto accident, your lower, personal limits will apply—not the higher business benefits.
These are unfair and confusing auto insurance clauses that penalize individuals, to the benefit of NJ employers and NJ auto insurance companies. These step-down clauses are extremely misleading, as individuals who drive for work, expect to be covered by their employer’s auto insurance policy. Furthermore, the NJ employee has no idea of the existence of the step-down clause until after an NJ auto accident has occurred.
Little do these employees know that they may only be covered by their personal NJ auto policies. Most of the time, the individual’s personal auto insurance policy is smaller and will provide fewer benefits after an NJ car accident.
A new Bill was just passed by the NJ Senate, in Trenton, that will prohibit the use of these unfair step-down clauses. Hopefully, it will be made into law soon.
