New Saile & Saile LLP Blog Section on PA & NJ Speed Traps!

As the Saile & Saile LLP Law Blog approaches its first anniversary, we are adding a new category to the Blog.

The “PA & NJ Speed Traps” category is now up and running. This is a place where anyone can post the location and type of a speed trap that they have seen or have been caught. You are welcome to post about any speed trap anywhere in the Commonwealth of Pennsylvania or the State of New Jersey.

We realize that other websites have compiled lists of places where speed traps have been found. Some of these websites are pay sites. The Saile & Saile LLP blog is always free. As the Saile & Saile LLP Blog gets more popular this feature will be able to reach out to more people.

Some police agencies publish their speed trap plans and locations, some do not. Our hope is that with your knowledge that PA & NJ police are enforcing the speed limits that our local streets and highways will become a safer place.

  1. I would of thought that posting spped trap information would be ilegal, as it interfere with police acrtivities.

    What if a person sees a speed trap, then goes a half mile up the road and stands there all day holding a sign up, slow down, speed trap ahead, would this also be legal?

    or like when you flash your highbeams at oncioming traffic to let them know a speed trap is ahead,…. i always thought this was ilegal.

    what about it?

  2. As far as I know its not illegal. Our goal is the same as police officers which is to make the streets safer.

    If I am informed that it is illegal and shown law telling me that it is illegal, I would be happy to remove this section of the blog.

    I do believe that the 1st Amendment of our Constitution is and should be very powerful.

    INCLUDING THE 4TH, 5TH, AND 6TH, AMENDMENTS., BUT I DIGRESS.

    Is it legal to signal other drivers there is a speed trap ahead?

  4. I have come to think that on the local level of State and Courts, that the constitution means absolutley nothing.

    For example, I recently heard a story about my ex attortney…. Apearantly the local prosecutor was in Judges chambers having an exparte conversation with the judge about one of his cases, and this attorney opend the door and said ” this is exparte and I object”.

    I belive there are constitutional issues with exparte commuinication, and the local State, and Local Courts just do not care.

  5. I find it very intresting topic that some local courts here in NJ have decided to ignore the Chun order and not hold DUI trials, but will then turn arond and say the NJ Supreme Court said the Alcotest is reliable and convict people on it, eventualy.

    I do not think it is LEGAL for local Courts to be allowed to pick and choose which NJ Supreme Court orders they want to follow and which ones they do not want to follow.

    I don’t thinki it is right, moral, or ethical, or legal!

  6. When we discuss the Bill of Rights, we must have an understanding about the origin of them, and why we live under them.

    Back in the late 1700′s, after ther Revolutuonary War was over, there was something called the “Constituional Convention”.

    Representatives from all the former colonies attended and two important things happened.

    One, they refused to ratify the constitution without the bill of rights aded on,- the first 10 amendments to the constitution.

    Two, the agreed to unify as a nation under this constituion and the only way to dismantle it would be to have 38% of the States petition congress for another constitutional convention.

    This have never happened as we have never reached ther 38% mark, but have come very close on several occassions.

    When I was in college in the mid 80′s, we were 3 or 4 States away from having a constituional convention.

    However, I do not see there is a problem with the Constitution. I see the problem as being local State government and Local courts just not adhearing to it. This is the problem.

    What we have is a system of governemnt that appears on the surface as Just and willing to abide by the Constitution, but in practice, the Constitution means nothing on the local level of Justice.

    I heard that flashing your lights to alert other drivers of a speed trap ahead is illegal and you can be given a citation for it. Maybe Mr. Saile can clarify, but I think it falls under the heading of interfearing with police activities. I do not think that Mr. Saile posting where speed traps is illegal, because the newspaper posts where the speed traps are located and they also post where DUI stops will be taking place at. It is public information. The police want you to know that there are out there and where they will be looking for you.

  8. I believe there are a few factors that are energizing what i have talked about above.

    1)a lot, a majority, of peole involved in “Local Justice”, defense attorneys, prosecutors, and Judges,…. are caught up in a few things.

    a) politics
    1) big politics
    2) interpersonal politics
    a)rubbing the court the wrong way with motions – not willing to do so

    b) a lost sense of Justice

    c) Wanting to represent themselves for their best “favor” , instad of under the Law

    2)The massive amount of cass to adjudicate

    3)A general sense by all parties that it is too hard and takes too much work to enforce an individuals constitutional rights
    a) causing exparte communication and constitutional violations

    I am defintivley dissalussioned by whtat is going on in NJ. I do not know how other States are.

    On one hand, individual defendants on the local level genrally believe I think that the Courts and prosecuitons are run in accordance withe Constitution,.

    On the other hand, the people responsible for this are so overwelmed with interpersonal politics that it is nearly impossible to afford a defendant these constitutionasl rights they expect!

  10. I’m sorry, I just kinda wanted to talk about the Bill of Rights, because you mentioned the first amendment.

    Here is a speed trap thing I want to bring up….

    In the neighborhood where I live, there are signs posted on many streets near RT9, that say, no parking 6am to 10am. These were posted about 13 years ago because many people from other towns were parkin gon our streets to get the bus to NYC.

    Now, in court, the prosecutors sometimes say that peole can not break traffic laws or local traffic ordinances ( or th elike) for any reason, even th epolice can not break them…

    This being said, I have seen many police cars parked on streets posted with no parking, sitting there taking radar, even out of the car , having a hand held radar device.
    I t happens on my street and the main street running throught he neighborhood.

    Is this legal, … Could I go to the town and press charges for violating the no aprking local ordinance by the police?

  11. Jim there may be some law or ordinance that says that if the police are on official business that they can park there police cars whereever they want. I do not know.

    (Did the State Police troper that was driving the Govenor and crashed the car wet a speedding ticket? I know the Governor got a seatbelt ticket)

    I was in a car accident 2 weeks ago, a person backing out of the WAWA here hit my car, never looked before backing out, I was stopped waitinbg for traffic…

    Whewn the police officer came,. the lot was so busy, he parked the police vehicle in a Handicap parking space. This was not an emergency situation and I would like to know idf this was legal.

    From what i understand the police are only allowed to break traffic laws or any laws in an emergerncy situation.

    A speed trap is not an emergency situation.

    Have you heard of this “emergency situation” thing, is it law or is it urban myth?

  13. This whole speed trap thing really bugs me.

    How many times have people driven down the GSP, Going from , lets say, Sayreville to Atlantic City, and have seen a police car blow past them at 80-90 mph without the cherry lights on… like a billion times, a trillion times… since they built the GSP.

    THEN THE SAME POLICE CAR IS PARKED on the side of the parkway, in between north and south, with the radar on, looking for those pareticular sports cars it just passsed.

    those cars he identified as potential speeders…

    One can argue the officer broke the traffic laws, in a non emergency situation, to set up a speed trap….

    what do you think, is this legal?

  14. Defense lawyers , as they should be, want to win cases, they want to win !, as they should.

    However, i feel, that defense lawyers, in general, (not you Mr. Saile, i am not talking about you, or know anything about your practice) …, would not try to investigate or bring up evidence a police officer has broken the law…

    I am not expecting every attorney to be a ben matlock, but what i do expect , but do not see happening, is defense attorneys using the law to its fullest extent in their practice.

    i feel generally that defense lawyers are fearful of using the law and every possible investigation and argument, because they will be ostrisized in every court they walk into, and most every motion will go against them once they have been branded with this reputation.

    I FEEL IF THERE IS ANY ILEGALITY TO ANY PARTICULAR SPEED TRAP, DEFENSE LAWYERS SHOULD NOT HESITATE TO INVESITGATE IT AND USE IT IN A DEFENSE.

    Mr. Saile, one thing I would like to know is the definition of “speed trap”.
