New NJ Wrongful Death Bill is slowly making progress to become the NJ Wrongful Death law

As we have informed you in previous blog entries, New Jersey has an old and somewhat unfair wrongful death law. Wrongful Death is a type of legal action or lawsuit brought when someone is “wrongfully” killed due to the negligence or intentional act of another. NJ does not provide for emotional damages suffered by close family members that result from the person’s unnecessary death. Under current NJ Wrongful Death law, only pecuniary (out-of-pocket) damages are recoverable in a lawsuit. This is unfair. Most states allow emotional pain and suffering damages for close relatives.

The Wrongful Death Bill S-176 was voted out of the Senate Judiciary Committee this afternoon, with a vote of 7 in favor and 4 in opposition. 

Many people and organizations have been fighting to make a change to NJ’s unfair Wrongful Death law including the New Jersey State Bar Association and ATLA-NJ. Hopefully this Bill will pass into NJ law soon! Many thanks to the hardworking individuals that have been fighting to make NJ law better for innocent victims.
