New NJ Wrongful Death bill almost law!

Update: the new NJ Wrongful Death bill is just one step away from being new law in New Jersey!

Yesterday, the NJ Senate and Assembly passed a Wrongful Death bill that expands the type of recoverable damages under wrongful death actions to include mental anguish, emotional pain and suffering, loss of society and loss of companionship. As we have previously reported to you, the current NJ Wrongful Death law provides little or no value for the lives of children or the elderly by allowing recovery in wrongful death actions for pecuniary loss only. This is simply not fair! This bill recognizes the full extent of loss and permits recovery accordingly.

The last step for this much needed amendment to the NJ Wrongful Death law is the signature of Governor, Corzine. I believe that he is a governor for the people, and will pass this bill.

This will be a win for innocent accident victims in NJ! Thanks to all involved!

  2. How much is suffering worth??????????? How much is watching someone you love more than life itself suffer worth ?????????? How much are physical, emotional, pain and devestation worth? How much are nightmares,or sleepless nights, depression, ptsd, flashbacks, nothing in the world for which to care worth????????????????

    My husband of 34 years died at age 54, mostly due to the horrific and moronic care at Somerset Hospital, Somerville, NJ. I died when he died. His date of death was March 15,2006, and I was wondering if there is any way to get an extension on the 2 year statuate of limitations.?

    I was also wondering if there was a lawyer and a dr. who still had a shred of the idealism they had when they entered their professions???$$$$$$$$$$$$$$$$$$$$$$$$

  4. I SUSPECT IF THE HOSPITAL OR DOCTORS DID ANYTHING WRONG, THAT PATIENT CHART IS LONG GONE LOST.

    When my dad dies almost 6 years, I contacted an attorney within a week and he told me it would be next to impossible to get the Chart for a law suit.

    Sorry to hear your horrible story.

    I am not a medical malpractice attorney, but I know there may be some exceptions to the medical malpractice statute of limitations.

    For example, if a doctor negligently does something to you and you do not know that he or she was negligent for more than 2 years, there may be an extension of time to the statute of limitations.

    I recommend that if you are up to it, that you get your case evaluated by the qualified NJ medical malpractice attorney asap.
