“First Party” is a common term used when you are talk about or referring to your auto insurance company or the company that you have a contract with. Common First Party benefits include medical bills, income loss protection, accidental death benefits, and funeral benefits.
So what happens if your PA auto insurance company does not pay your medical bills, income loss or other benefits after a PA car accident? You must sue your PA auto insurance company.
When must you sue your PA auto insurance company?
Section 1721 of the Pennsylvania Motor Vehicle Code states that if First Party benefits have not been paid, a lawsuit must be filed against the PA auto insurance company within four years from the date of the PA car accident that caused the injuries that require the medical treatment.
If any First Party Benefits have been paid, the lawsuit must be filed within fours years from the last date of payment of a First Party benefit that resulted from the PA car accident.
If minors are involved (people under 18 years old), a lawsuit for First Party Benefits must be filed within four years form the date on which the injured minor attains 18 years of age.
