Fatal Pennsylvania car accident in Plumstead.

William Campagna, 22 years of age, was hit and killed by a vehicle on Friday, February 20, 2009 at approximately 2:30 a.m. while walking on Easton Road (Route 611) in Plumstead Township, Bucks County, PA. Mr. Campagna was hit by a Jeep Grand Cherokee driven by John Lake, Jr. of Pipersville, PA.

According to Plumstead Township Police Chief, no charges have been filed against Mr. Lake. Police Chief Hasenauer reports that Mr. Campagna was wearing dark clothing at the time he was struck while walking along Easton Road. It was reported that Mr. Campagna had been at the Big Heads Bar on North Easton Road for a little over a half hour on the night of the fatal Pennsylvania car accident and had had a couple of beers.

William Campagna’s family can bring a wrongful death action in the Court of Common Pleas of Bucks County, Pennsylvania against the driver of the Jeep. These types of Pennsylvania personal injury cases are difficult to recover when there is a pedestrian dressed in dark colored clothing. This is because a Plaintiff has to prove that the driver was negligent. Furthermore, there are usually no witnesses to these types of fatal pedestrian car accidents making it difficult for a Plaintiff to prove his or her case.

  1. I guess the hope it that the driver did not have a drivers licenser, registration, or insurance.

    Just because no chargews were filed, and an insurance card was present, doesnt mean that the vehicle was actually insured, .. as in payments up to date and policy not cancelled.

    If the driver had no insurance, that means he shouldnt have been driving, and that is the negligent act in of itself, or should be considred to be.

    However, this is two fold, because without insurance, what are you really going to get out of law suit. Most people , espe4cially these days, are in debt, and do not have any monetary value.

    I wonder if the pedestrian can put a claim on his car insurance.

    If the person had been catostophically injured, instead of died, …. this would be an intresting case, … and that statement alone is unfortunate. i realize that.
