Camden County NJ man charged with death by auto…

On November 16, 2008, a fatal crash occurred at Erial and Hickstown Roads in Gloucester County, NJ killing Delaware County, PA resident Frank Serratore III.

A Camden County, NJ man, Michael Whittingham of Wayside Road in Berlin, initially charged with aggravated assault with a motor vehicle and driving under the influence of alcohol, has ultimately been charged with death by auto in this case.

Mr. Serratore died at Cooper University Hospital on December 7, 2008. The accused, Mr. Whittingham, is said to have crashed his Dodge pickup truck into the driver’s side door of a Ford pickup truck operated by Mr. Serratore.

Mr. Whittingham is free on bail but faces a 10-year maximum sentence if convicted of this death by auto charge.

  2. I KNOW THAT NJ DOES NOT HAVE FELONIES, BUT NY DOES, NOT SURE about penn.
    JUST FROM WATCHING THE TV SHOW LAW AND ORDER , AND THEY DO HAVE REAL ATTORNEYS TO CONSULT FOR THE SCRIPTS, I THINK THAT THE AGGRAVATED ASSAULT IS A FELONY, AND THE RESULTING DEATH FROM THE FELONY, MAKES IT FELONY MURDER, THATS 25 TO LIFE, AND POSSIBLE DEATH SENTENCE. HOW CAN THE PERSON, IF GUILTY, BE GETTING AWAY WITH HAVING TO DO ONLY 10 YEARS?
